What responsibilities will a producer have?
The Regulations require producers to report the weight in tonnes that they place on the UK market. This weight should include the whole electrical or electronic product itself, any electrical or electronic accessories supplied with it and any non electrical accessories that are specific to the product or likely to be regarded by the purchaser as part of the overall product and therefore likely to be discarded with it at end of life. Packaging, instructions and other paperwork should not be included.
If you are a producer, you must:
1. Join an approved producer compliance scheme (PCS) such as Comply Direct Ltd by 15th March 2007 for compliance period one or within 28 days of entering the UK EEE market.
Comply Direct on behalf of the Producer will register them with the relevant authorities, report the EEE placed on the market by the producer, arrange the collection, treatment and environmentally sound disposal of an amount of WEEE deposited at DCFs or returned under Regulation 32, and declare this, supported by evidence, to the appropriate authorities.
2. Pay your chosen compliance scheme according to its fee structure and membership rules.
3. Provide information to your compliance scheme about your business, and the amounts of EEE you place on the UK market in tonnes on a quarterly basis, broken down by compliance category and its B2B or B2C nature.
4. Mark the EEE you place on the UK market with the ‘crossed-out wheeled bin’ symbol and your unique producer identification mark as reported with your registration. The crossed-out wheeled bin and data markings can be purchased via BSI online.
5. Make information available to operators of treatment and reprocessing facilities.
This relates to EEE placed on the market and includes information about the different materials and components of EEE, and the location of any hazardous substances. This requirement applies from 1st April 2007 and the information must be made available within one year of the EEE having been placed on the UK market.
6. Provide your producer registration number to distributors to whom you supply EEE.
This is to confirm to distributors that they are purchasing EEE from registered producers in the UK. This registration number can be incorporated into letterheads or onto invoices for example. This number will remain the same from compliance period to period and even if a producer switches compliance schemes at the end of a compliance period. The number will be issued by the relevant authority and issued to producers via their compliance scheme before 1st July 2007.
7. Retain records for a period of four years.
