The European Commission has published a draft implementing regulation on the registration and reporting of WEEE producers across all member states
The draft puts forward a harmonised approach in a bid to reduce the administrative burden on producers with obligations in multiple member states. If implemented, the amendments to the Regulations will come into force in January 2019 and will be ‘binding in entirety and applicable to all member states’, meaning that the UK would not need to take any action to incorporate them into UK law.
Impact upon Data Reporting
- Producers registered direct with the Environment Agency will be required to report on a quarterly basis, within 30 days of the end of the three-month period. These producers currently submit on an annual basis.
- Producers registered with the Environment Agency via a third party will be required to report on an annual basis, within three months of the end of the calendar year. These producers currently submit on a quarterly basis.
- All member states will be required to ensure that their register of producer data is in line with the format set out by the Commission. This should detail: producer name, registration code, tax number, reporting period, contact name, EEE placed on market per category and obligation type,
Impact upon Producer Registration
- A set format outlining the core information to be requested at the point of registration will be established. This gives limited scope for member states to collect additional information not directly relevant to the registration of the producer. Information requested should be: producer name, producer trading name, producer address, contact name, registration code, tax number, EEE categories and obligation type, EEE brand names, use of distance selling. This information is currently requested upon registration in the UK.
